Oracle Issues Force Majeure Notice for Stargate Data Centre

Oracle has issued a force majeure notice to the developer of Project Jupiter, a Stargate data centre campus in New Mexico, as delays involving the facility’s energy supply raise questions about its construction timeline. Bloomberg first reported the notice on Thursday.

The notice does not mean Oracle is withdrawing from the project. According to Bloomberg, it could allow the company to delay payments if the campus misses its planned 2028 opening because of circumstances outside its control.

Oracle Says Project Jupiter Remains on Schedule

Oracle maintains that it does not expect a delay. In a statement to CNBC, the company said Project Jupiter remains on its planned schedule and reaffirmed its commitment to New Mexico.

Blue Owl Capital, whose unit received the notice, told CNBC that it is not changing its financial commitments to the multiyear project.

Energy Permits and Pipeline Delays

The campus is designed to support 2.45 gigawatts of capacity and is expected to rely on gas-powered fuel cells supplied by Bloom Energy. That makes access to natural gas a key part of its development timeline.

An Energy Transfer pipeline planned to supply the site has been delayed to February 1, 2027, following repeated permit denials. Bloomberg reported in August that regulators rejected earlier proposals and the pipeline route changed.

A separate air-quality permit for the campus’s fuel cell system is also pending. New Mexico’s environment department faces a November 23 deadline to decide on that application.

Project Jupiter is part of Stargate, the AI infrastructure initiative announced by Oracle, OpenAI, and SoftBank. The campus has faced opposition from some residents and environmental groups over its potential impact. Oracle says it remains committed to moving the project forward.
